Understanding Alcohol Use Disorder
What Is Alcohol Use Disorder?
Alcohol Use Disorder (AUD) is a chronic relapsing brain disease characterised by an impaired ability to stop or control alcohol use despite adverse social, occupational, or health consequences. Classified under DSM-5 (303.90) and ICD-11 (6C40), it encompasses conditions previously referred to as alcohol abuse, alcohol dependence, and alcoholism.
In legal proceedings, the distinction between “harmful use” and “alcohol dependence syndrome” is often critical. Our experts assess the severity of the disorder—ranging from mild to severe—and its impact on cognitive functioning, volitional control, and risk profiles across criminal, family, and civil jurisdictions.
Diagnostic Criteria (DSM-5)
A diagnosis of AUD is based on a pattern of alcohol use leading to clinically significant impairment or distress, as manifested by at least two of the following occurring within a 12-month period:
Impaired Control
- Alcohol taken in larger amounts or over a longer period than intended
- Persistent desire or unsuccessful efforts to cut down or control use
- Great deal of time spent obtaining, using, or recovering from alcohol
- Craving, or a strong desire or urge to use alcohol
Social Impairment
- Recurrent use resulting in failure to fulfil major role obligations at work, school, or home
- Continued use despite persistent or recurrent social or interpersonal problems
- Important social, occupational, or recreational activities given up or reduced
Risky Use & Physical Issues
- Recurrent alcohol use in situations in which it is physically hazardous
- Use continued despite knowledge of having a persistent physical or psychological problem likely caused by alcohol
Pharmacological Criteria
- Tolerance (need for increased amounts or diminished effect)
- Withdrawal (withdrawal syndrome or use of alcohol to relieve/avoid symptoms)
Severity Scale: Mild (2–3 symptoms) | Moderate (4–5 symptoms) | Severe (6 or more symptoms)
Legal Significance
AUD is frequently associated with **dual diagnosis criminal** contexts, where comorbid mental health disorders (such as depression or PTSD) interact with substance use. Expert evidence is required to distinguish between voluntary intoxication—which generally does not provide a defence—and an underlying substance-induced disorder or dependence syndrome that may affect **mens rea** or sentencing mitigation.
Alcohol Use Disorder in Legal Proceedings
Assessments of alcohol dependence and substance-induced states are vital across multiple legal domains. Courts require expert evidence to address complex questions regarding culpability, safety, and rehabilitation:
The distinction between alcohol-induced states and independent psychiatric disorders is essential for accurate legal disposal and sentencing.
