Acute Stress Disorder (ASD)
Expert Psychiatric Assessment
Evaluating the immediate psychiatric response to trauma. Our specialist psychiatrists provide comprehensive ASD assessments for legal proceedings, identifying symptoms within the critical 30-day window following a traumatic event to establish causation and prognosis.
Understanding Acute Stress Disorder
What Is Acute Stress Disorder (ASD)?
Acute Stress Disorder (ASD) is a psychiatric condition that can occur in the immediate aftermath of a traumatic event. Clinically defined under DSM-5 (308.3), ASD involves a similar symptom profile to Post-Traumatic Stress Disorder (PTSD) but is specifically diagnosed when symptoms persist for at least three days and up to one month following exposure to actual or threatened death, serious injury, or sexual violation.
In a legal context, an ASD assessment is vital for documenting the “nervous shock” or immediate psychological damage sustained by a claimant. If symptoms continue beyond the one-month mark, the diagnosis may transition to PTSD. Expert psychiatric evidence is essential to differentiate between a transient stress reaction and a burgeoning chronic trauma disorder.
Diagnostic Criteria (DSM-5)
A diagnosis of ASD requires the presence of nine or more symptoms from any of the following five categories, beginning or worsening after the traumatic event occurred:
Intrusion & Negative Mood
- Recurrent, involuntary, and intrusive distressing memories
- Distressing dreams related to the event
- Dissociative reactions (e.g., flashbacks)
- Intense prolonged psychological or physiological distress
- Persistent inability to experience positive emotions
Dissociative Symptoms
- An altered sense of the reality of one’s surroundings or oneself
- Inability to remember an important aspect of the traumatic event
- Feeling in a daze or “numb” immediately following trauma
Avoidance Symptoms
- Efforts to avoid distressing memories, thoughts, or feelings
- Efforts to avoid external reminders (people, places, conversations)
Arousal Symptoms
- Sleep disturbance (difficulty falling or staying asleep)
- Irritable behaviour and angry outbursts
- Hypervigilance and exaggerated startle response
- Problems with concentration or focus
Duration: Symptoms must last for a minimum of 3 days and a maximum of 4 weeks after trauma exposure.
Prevalence and Legal Significance
Acute Stress Disorder is frequently observed following road traffic accidents (RTAs), industrial disasters, and violent assaults. Approximately 20-50% of individuals who experience interpersonal trauma (such as assault or witnessing a mass shooting) develop ASD. In personal injury litigation, early assessment of ASD provides a contemporaneous record of psychiatric injury, which is critical for establishing the “but for” test in causation.
ASD in Legal Proceedings
Early psychiatric intervention and assessment of ASD are crucial for solicitors managing personal injury or clinical negligence claims. Our experts address the following specific legal requirements:
An ASD assessment acts as a “snapshot” of the claimant’s mental state, preventing the loss of vital evidence as time passes.
Legal Areas Requiring ASD Assessment
Personal Injury
RTAs, slips and trips, and workplace accidents where immediate trauma is evident.
Criminal Proceedings
Victim impact statements and assessing the mental state of complainants post-assault.
Clinical Negligence
Psychological shock resulting from surgical errors or traumatic birth experiences.
CICA Claims
Establishing psychiatric injury for victims of violent crime within the scheme’s window.
Employment Law
Acute reactions to workplace violence, bullying, or sudden traumatic termination.
Immigration & Asylum
Assessing recent trauma in asylum seekers to support urgent stay of deportation.
